Acceptable Use Policy

  1. 1. Introduction

    1. This acceptable use policy (the “Policy“) sets out the rules governing:
      1. the use of the website at https://pocketfolio.net any successor website, and the website builder, hosting and other services available on that website or any successor website (the “Services“); and
      2. the transmission, storage and processing of photographs, videos, text and other content by you, or by any person on your behalf, using the Services (“Data“).
    2. References in this Policy to “you” are to any customer for the Services and any individual user of the Services (and “your” should be construed accordingly); and references in this Policy to “us” are to Pocketfolio (and “we” and “our” should be construed accordingly).
  2. 2. General usage rules

    1. You must not use the Services in any way that causes, or may cause, damage to the Services or impairment of the availability or accessibility of the Services.
    2. You must not use the Services:
      1. in any way that is unlawful, illegal, fraudulent, deceptive or harmful; or
      2. in connection with any unlawful, illegal, fraudulent, deceptive or harmful purpose or activity.
    3. You must ensure that all Data complies with the provisions of this Policy and that any content embedded in a website by means of the Services complies with this Policy. In particular, we would like to draw your attention to Section 3.2(c), which prohibits the uploading of any material that infringes copyright and Section 3.2(d), which prohibits the uploading of any material that breaches any persons right to privacy or data protection rights. In many cases, you will need the consent or agreement of any person that takes a photograph, or that appears in a photograph, before uploading that photograph to the Services.
  3. 3. Unlawful Data

    1. Data must not be illegal or unlawful, must not infringe any person’s legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law).
    2. Data, and the use of Data by us in any manner licensed or otherwise authorised by you, must not:
      1. be libellous or maliciously false;
      2. be obscene or indecent;
      3. infringe any copyright, moral right, database right, trade mark right, design right, right in passing off, or other intellectual property right;
      4. infringe any right of confidence, right of privacy or right under data protection legislation;
      5. constitute negligent advice or contain any negligent statement;
      6. constitute an incitement to commit a crime, instructions for the commission of a crime or the promotion of criminal activity;
      7. be in contempt of any court, or in breach of any court order;
      8. constitute a breach of racial or religious hatred or discrimination legislation;
      9. be blasphemous;
      10. constitute a breach of official secrets legislation; or
      11. constitute a breach of any contractual obligation owed to any person.
    3. You must ensure that Data is not and has never been the subject of any threatened or actual legal proceedings or other similar complaint.
  4. 4. Graphic material

    1. Data must be appropriate for all persons who have access to or are likely to access the Data in question, and in particular for children over 12 years of age.
    2. Data must not depict violence in an explicit, graphic or gratuitous manner.
    3. Data must not be pornographic or sexually explicit.
  5. 5. Additional rules

    1. Data must not be offensive, deceptive, threatening, abusive, harassing, menacing, hateful, discriminatory or inflammatory.
    2. Data must not be liable to cause annoyance, inconvenience or needless anxiety.
    3. You must not use the Services to send any hostile communication or any communication intended to insult, including such communications directed at a particular person or group of people.
    4. You must not use the Services for the purpose of deliberately deceiving, upsetting or offending others.
  6. 6. Monitoring and moderation

    1. You acknowledge that we may actively monitor the Data and the use of the Services, but we do not undertake to do so.
  7. 7. Data mining

    1. You must not conduct any systematic or automated data scraping, data mining, data extraction or data harvesting, or other systematic or automated data collection activity, by means of or in relation to the Services.

  8. 8. Hyperlinks

    1. You must not link to any material using or by means of the Services that would, if it were made available through the Services, breach the provisions of this Policy.
  9. Embedded content

    1. If you embed any content that is hosted by any third party in the Services, then you must ensure that you comply with the relevant third party’s terms and conditions in relation to such embedded content, and ensure that the embedded content complies with this Policy.
